CENTR has published a Board statement on data retention for law enforcement purposes.
In the context of the ongoing call for evidence on the impact assessment on the retention of data by service providers for criminal proceedings, CENTR members highlight that:
- Any mandatory data retention regime applicable to European ccTLDs should come with a proper impact assessment to evaluate feasibility and utility of such data for law enforcement purposes.
- Lengthy or indiscriminate data retention would create significant financial and operational burdens for ccTLD registries, including infrastructure, IT, and staffing costs.
- A mandatory EU-wide cost reimbursement mechanism would help offset the costs of compliance.
- Voluntary cooperation mechanisms with law enforcement, such as sharing threat intelligence and non-personal data, should be further promoted across the EU.
